1. This website, www.ginagallery.com (“the website”), is solely owned by GINA World of Naive Art Ltd. (“the company”). It serves as a comprehensive commercial platform allowing direct purchase of premier naïve art and design, along with exposure to various related content (“the service”).
2. The company reserves the right, at its sole discretion and without prior notice, to amend these terms, including the website’s terms of use, the terms for purchasing art through the site, event participation terms, the structure, content, appearance of the site, and any other aspect related to the site and its operation. Such changes will take effect from the date of their publication on the site unless stated otherwise by the company.
3. The company does not guarantee uninterrupted use of the site or that it will operate without interruptions, failures, or malfunctions, including hardware, software, or communication line failures. The company will not bear any direct or indirect responsibility in this regard, and the user will have no claims, demands, or suits against the company, its owners, managers, employees, site operators, or any affiliates in this context.
4. The company, its owners, managers, employees, site operators, or any affiliates will not be liable for the server through which the site operates, nor for it being free from viruses or other components that may damage the user’s personal computer during browsing, purchasing from, or any use of the site. The company will not bear any direct or indirect responsibility in this regard, and the user will have no claims, demands, or suits against the company, its owners, managers, employees, site operators, or any affiliates in this context.

6. The company, its owners, managers, employees, site operators, or any affiliates are not responsible for any illegal activity carried out, if any, by any site user or any entity beyond their control.
7. The company reserves the right to prevent or terminate any user’s access to any part of the site for any reason and at its sole discretion, without the user having any claim, demand, or suit against the company, its owners, managers, employees, site operators, or any affiliates in this context.
8. All intellectual property rights on the site and any related module, including copyrights, patents, and trademarks, are the exclusive property of the company. Any use for any purpose without the company’s explicit prior written consent is strictly prohibited.

12. Purchasing art through the site – Artworks can be purchased through the site, with prices detailed on the site. The company reserves the right to change sale terms or artwork prices with or without prior notice, provided that the terms for artworks already purchased will not change.
13. Availability of Paintings – The company does not guarantee the availability of the artworks displayed on the website at any given time. Certain artworks offered for sale may be sold or become unavailable without prior notice. In cases where a user orders an artwork that is no longer available, the company will notify the user as soon as possible and will not bear any liability for the unavailability. The user will have no claims, demands, or suits against the company, its owners, managers, employees, site operators, or any affiliates in this regard.
14. GINA World of Naive Art Ltd. may offer you to subscribe to its newsletter and receive correspondence and notifications via the email provided during registration. You may unsubscribe at any time through the ‘unsubscribe’ link at the end of the newsletter or by emailing [email protected].
15. The exclusive jurisdiction for any matter relating to the site or these terms will be the competent court in Tel Aviv, which will adjudicate the matter according to the laws of the State of Israel without giving effect to the rules of conflict of laws.

Event’s Tickets Cancellation Policy

1. Tickets can be canceled within 14 days from the date of the order, provided the cancellation is no later than 3 business days before the event date.
2. A cancellation fee of 10% of the transaction amount will be charged in case of order cancellation.

Terms Related to Use of the Store and Sales Operations

1. The price of the artworks is as detailed on the sales page of each artwork displayed on the platform.
2. The displayed prices include handling, packaging and shipping.
3. Payment can be made via credit cards and/or additional platforms such as Apple Pay, Google Pay, etc.
4. The Company reserves the right to change payment options at any time and for any reason.

Exchange and Return Policy

1. Except in cases provided by Israel’s Consumer Protection Law 1981 (“the law”), no refund will be given for product purchases.
2. Artworks may be returned and purchases canceled or exchanged within 14 days of receiving the artwork, provided it has not been used, is undamaged, and is kept in its original packaging.
3. In the case of returning an artwork, a refund will be given minus a 5% deduction. Additionally, the customer will be charged for packaging, handling and shipping fees paid by the company (if paid) plus VAT (if paid). The refund will be processed within 14 business days from the date of return in the original payment method and terms.
4. There is no need to contact the credit card company to cancel the transaction.
5. To return an artwork, please send an email to [email protected] with the artwork details, an invoice copy, and the reason for return. The Company will contact you within 3 business days.
